1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Health Aevum AI Inc. (Delaware) ("Company," "we," "us") for the ÆVUM mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download or use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple- or Google-branded device that you own or control, solely for your personal, non-commercial purposes.

3. Restrictions

You may not:

Copy, modify, or distribute the App or any content therein
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App
Remove or alter any proprietary notices or labels on the App
Use the App for any unlawful purpose or in violation of any regulation
Use the App to transmit any harmful, offensive, or disruptive content

4. Intellectual Property

The App, including all content, features, and functionality, is owned by Health Aevum AI Inc. (Delaware) and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws. This EULA does not transfer any intellectual property rights to you.

5. In-App Purchases and Subscriptions

The App offers optional in-app purchases and subscriptions. All digital purchases made through the App on iOS are processed by Apple's App Store, and on Android by the Google Play Store, subject to their respective terms and conditions. Physical product purchases may be processed through our third-party payment processor. All purchases are final unless required by applicable law or the applicable platform's refund policy.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You may manage or cancel subscriptions through your device's App Store or Google Play account settings.

6. Health and Medical Disclaimer

The App provides general fitness, nutrition, and wellness information for educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider before beginning any exercise program, changing your diet, or making any other health-related decisions. 7. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into this EULA by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

8. Third-Party Services

The App may use or link to third-party services, including but not limited to Apple HealthKit, Google Fit, Stripe, and analytics providers. Your use of those services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or terms of any third-party service.

Apple HealthKit: Data obtained from Apple HealthKit will not be used for advertising or sold to data brokers. It will only be used to provide and improve health and fitness features within the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEALTH AEVUM AI INC. (DELAWARE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

This license is effective until terminated. It terminates automatically if you fail to comply with any term of this EULA. Upon termination, you must destroy all copies of the App in your possession. Sections 4, 6, 9, 10, 12, and 13 survive termination.

12. Apple and Google as Third-Party Beneficiaries

You acknowledge that Apple, Inc. and Google LLC are third-party beneficiaries of this EULA and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. Apple has no obligation to furnish any maintenance or support services with respect to the App.

13. Governing Law

This EULA is governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
